Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')(FOIA)

Thank you for your email dated 13 March 2012 in which you made a request for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked: 

  1. "I am writing to ask you to disclose to myself the number of times Denton Bank Allotments off Silver Lonnen has been burgled

  2. and how many times your officers have had to attend due to the damage caused by vandalism.

  3. the number of times the fire brigade have had to attend over the last 5 years.

  4. I would like you to disclose the amount of allegations of named person has made against myself."

In response:

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Following receipt of your request, searches were conducted with the Corporate Development Department of Northumbria Police.  I can confirm that the information you have requested is held, in part, by Northumbria Police.

I have decided to disclose the located information to you as follows.

  1. 17 Burglary Other than Dwellings have been recorded at Denton Bank Allotments between April 2007 and 13th March 2012.

  2. There have been 11 criminal damages recorded for the same time period as above.  Officers have attended on each occasion.

  3. No information held.  Enquiries regarding how many times the fire brigade has attended should be directed to them.

  4. With regards to any allegations made against yourself Northumbria Police can neither confirm nor deny that it holds the information you requested as the duty in s1(1)(a) of the Freedom of Information Act 2000 does not apply, by virtue of the following exemptions:

S40(5) Personal information 
Under the Freedom of Information Act, information that is disclosed is released to the public as a whole and not just to the individual applicant. As such, Northumbria Police would not wish to confirm or deny to the public at large whether information is held about any individual.

You should consider this to be a refusal under section 17 of the Act.

No inference can be taken from this refusal that the information you have requested does or does not exist.

You may be interested to know that Northumbria Police routinely publish information that has been disclosed by Northumbria Police in response to requests made under the Freedom of Information Act 2000 via the Disclosure Log.  The aim of the Disclosure Log is to promote openness and transparency by voluntarily placing information into the public arena.
